There have been a number of important legal cases and updates since the passing of the citizenship provision in March 2017, some of which have been highlighted below.

In June 2017, the Regional Passport Office (RPO) in Bangalore released a set of guidelines for Tibetans to follow when applying for Indian passports. These guidelines include:

  • Surrendering one’s RC/IC card

  • Illegal to return back to one’s original refugee settlement

  • Submitting a written paper stating renouncement of Central Tibetan Administration (CTA) benefits

  • Submitting a written paper stating renouncement of RC/IC benefits

Tamding Dorjee v. Government of India Ministry of External Affairs was a court case in November 2017 that reviewed the constitutionality of this provision issued by the RPO Bangalore. The Delhi High Court ruled that three out of the four rules were constitutional, with the exception of rule two, that Tibetans will be prohibited to return to their original refugee settlements, which they ruled unconstitutional.
